I am a EB2 Greencard holder, it’s been 2.5 years approx I got my green card. Recently I got a DUI (1st DUI) and court has given the following terms, the case is continued till March 18th citing to check with immigration lawyer. On March 18th the court may keep the same charges as mentioned or may reduce to reckless driving depending on prosecutor. What are the effects on current permanent residency and while applying citizenship. For now the options court gave me below (should obey all of them), I decided to continue to check with immigration attorney. ——— Plead guilty to “DUI misdemeanor” with the following agreed sentence terms: 1. 30 days jail with all 30 days suspended (so NO jail time to serve). 2. Good behavior for 1 year (this means if you are convicted of any violations of the law for the next year, some part of the suspended jail sentence can be imposed). 3. Completion of ASAP (Alcohol Safety Action Program in VIrginia) 4. $250 fine 5. Driver's License suspended for 12 months. Please advise implications on current permanent residency (port of entry or any other) and while applying citizenship? If given a option between reckless vs DUI which one would be better.
