Question

My H1-B has been approved, and I applied for my spouse's H4 (I-539) and H4 EAD (I-765) along with Form G-1145. USCIS received the applications on December 11th, and I am currently waiting for the receipt notice to be generated. My spouse's I-94 expired on December 12th. Based on my research, as long as the receipt notice is generated, it should not pose a problem. Please advise if this understanding is incorrect. However, my concern is what happens if, for any reason, the application is rejected, as this would leave my spouse out of status. This situation worries me because, initially, I filed the H1-B, H4, and H4-EAD applications together, but due to an error on Form G-1450, the H1-B was approved while the H4 and H4-EAD applications were returned. I had to refile them with checks at the last minute, and they were received by USCIS on December 11th, just one day before my spouse's I-94 expired.
