Background- The guy (Indian citizen) on H1-B was laid off on 15th April 2020 due to COVID. The H1B is valid until June 2022. No stamping on the passport as the visa was transferred from F1 to H1 in October 2019. The I-94 states "Admit Until Date: D/S". To remain in the US- He filed a change of status to B1/B2 on 1st, June 2020. As per the USCIS website, the change of status case is still pending. The biometric is still pending and the office is still closed. Can he stay legally in the US until the H1 to B1 case pending has a decision? Is he in legal danger? Has he broken any law so far? Given he has an offer letter, Is he still eligible for an H1 transfer while remaining in the US? If yes, until what date he has the time? What are his options now? Best, Gaurav
