This is regarding moving from H1-B to H4 and H4 EAD application process. Situation: ======= I reside in Bay Area, California and my wife is currently working in Dallas, Texas on an H1-B visa. Her employment with her current employee will end on September 17, 2018 - she is being terminated by the employer as she could not find suitable projects in bay area, California. Questions: ========= 1. Given this situation, regarding her employment and visa status, can she still be in US, unemployed, for 2 months (starting from Sep 17, 2018), as her H1-B is valid till March 2020, even though she will be unemployed after Sep 17, 2018 ? 2. How long is the application process for H4 and H4 EAD for her in this scenario ? 3. Is traveling outside US, prohibited during H4/H4 EAD application process ? 4. When can she officially move to California, and when is she eligible to apply for her Driver’s license (currently she does not have one) ? 5. In future, if she wants to switch back to H1-B will she be exempt from the H1-B cap rule ?
