My wife who recently returned to India after her H1-B extension denial. In India, she recently received H-4 visa approval (already stamped). Now, her employer is re-initiating her H1-B petition again from India. She has I140 approval, and is cap exempted. My question is around subsequent H1-B petition approval and stamping – and the impact on her already approved H-4 VISA (stamped). My understanding is before you go for visa stamping your petition has to be approved. Specifically, I have following questions: 1) What would happen to her already approved H-4 VISA, when her H1-B petition is approved (not yet stamped)? 2) If H4 Visa is still valid at the time of H1B extension petition approval, what would happen to her H4 Visa when she goes to consulate for H1b stamping?
