I am on H4 since Jun '15 and also have an H1B Petition filed as CONSULAR PROCESSING by company A in Apr '16, approved by USCIS in Dec '16 and valid till Dec '17. I never used this petition and is now expired. I am currently on valid H4. Now, I have found a new role in company B who will file a new CAP EXEMPT petition. 1. Can company B file the new H1B petition for Change of Status (COS) from H4 to H1B? Since petition by company A was filed for Consular Processing, does company B also have to file for Consular Processing? 2. If company B' petition is approved, will I receive i94? If yes, will my status immediately be changed from H4 to H1B? 3. If company B' petition is approved and I receive i94, can I start working immediately for company B or do I have to travel outside country and get visa stamped before joining company B? 4. What are the chances that the petition is approved and I won't receive i94? 5. Do I have to travel outside country for stamping if petition is approved but I do not receive i94?
