Question

I am writing to seek your expert advice on an immigration matter concerning my wife. Currently holding an H4 visa, she is in the process of transitioning to an F1 visa. After applying for a drop box, she received a 221G letter instructing her to attend an interview on or after January 12, 2024. Unfortunately, the academic semester she applied for commences on January 16, 2024. The Designated School Official (DSO) has advised us to defer the semester if she cannot join by that date. The 221G letter provides a 12-month response window. Given this timeframe, we are contemplating the option of her traveling to the USA on her H4 visa. Our plan is for her to attend the F1 visa interview in May 2024, utilizing the new I20 for the Fall semester of 2024. I would appreciate your insights on the following queries: Is it permissible for my wife to travel to the USA on her H4 visa during this period? Can she attend the F1 visa interview in May 2024 with the new I20 for the Fall semester of 2024? Are there potential issues or considerations we should be aware of in pursuing this course of action?
