Question

Hello, I am currently working for company A (Pharmaceutical) on an H1-B Visa. MY current visa expires on 19OCT2024. MY I-140 is in processing (Premium upgraded on 14JUN2024). I have received an RFE on 21JUN2024 (waiting on what the RFE is about). My PERM PD is 04JAN2023 (Approved on 05FEB2024). Company A has been sold to Company B (Pharmaceutical all assets acquired) and as part of the sale closure Company B is willing to retain me. Currently as part of the transition I will still be employed with Company A till 31OCT2024 (which may extend to 31DEC2024) to help with de-commission activities and company B will take over after. We were waiting for I-140 approval to do the H1 extension. In the event that an RFE has been issued, in this situation what are my options? Can company A still do my H1 extension? or it has to be done by company B? In the event, my I-140 gets approved, do company B have to restart my whole I-140 process including PERM again? or if my I-140 gets denied for several reasons (worst case), what are my options? Can I use the existing PERM and can company B do my I-140 again? Please guide. Thanks
