I want to apply a new H1B petition with an employer who is willing to sponsor. I have worked in US for 12 years on h1b visa and moved to India in 2019 due to family reasons. I have 2 active I-140s from 2 different companies. My priority date in EB2 is June 25th, 2010 which is current at this moment. 1. Can we apply my H1b petition in cap exempt quota? Am I entitled to receive 3 year h1b approval with my previously approved I-140? My understanding is that once I-140 is approved, I am eligible for cap exempt h1b application indefinitely. Please provide inputs on this. 2. Since my priority date is already current, can I apply for Green Card as a future employment option while residing in India? Can I come to US once my I-485 is approved? Please clarify.
