Hello, Background: H1B with approved I-140 with employer A. Category: EB-2. Priority date: July 2017. Is it more than 180 days after I-140 approval: YES. Is I-485 filed: NO. I am planning to change job from employer A to employer B. Employer B is ready to hire by only transferring H1B but not willing to port I-140 and wont file I-485. Employer B says it can provide 'Supplement J' and employee can file I-485/AOS by themselves. Queries: If/When I join employer B and employer A withdraws I-140 application and employer B has not done new I-140: 1) Once priority date is current, in any case can an employee (not employer) file I-485 using 'Supplement J' provided by employer B. If yes, what else does employee need to make sure to file I-485 correctly. 2) Also while filing I-485/AoS what all support does employee need from I-140 employer(A). Thanks!
