My case detail Myself - L1A visa granted on Jan 13,2021 Wife - L2 Visa granted on Jan 13,2021 My kids - US citizens Past Details I have travelled to USA multiple times from 2011 to 2019 on H1B Visa. I had approved I-140 on H1B with priority date 15 Jan 2013. I was out of USA from 2019 to Feb 2021. For last 2 yrs I was in India. Travel Details Myself - Came to USA on Feb 18, 2021 (50 days) Wife - Came to USA on April 9, 2021 (Just came) Additional Details My I-140 was approved while I was in India. It was approved before getting the L visa in Nov 2020. I-140 on the basis of L1A has priority date 15 Jan 2013 ported from the Old I-140. Earlier I had plans to do the processing through NVC consular processing. But Now as I am in USA , I am thinking to file the change of status. Qs: 1. As I am planning to file the change of status. Considering L1 visa, Is there need to wait for the 90 days? Can I file now? 2) Does the 90 days rule apply for Derivative visa as My wife and I has different travel dates? 3) Is the 90 days calculated from application received date or when we send the application? 4) Can medical be done within 90 days if wait is recommended?
