My question is with reference to the recent movements in visa bulletin dates for India. I am an Indian citizen and I have an approved I-140 from company A (previous employer) and company B(current employer) priority date Dec 12, 2013. 1) With my current employer, during an EB2 to Eb3 downgrade process CAN USCIS eventually challenge the current EB2-PERM and revoke it thereby ultimately revoking the EB2 approval. 2) If this happens, can I use the I-140 from the previous employer as basis for H-1B extensions beyond 6 years. 3) Can I restart the PERM and I-140 process with the current employer if (1) happens. 4) if the process for downgrade goes through and if I get an EAD, what rules I have to follow in order to maintain my status then.
