Scenario: I’m currently on H-1B, 7th year (current 3 year extension based on approved I-140) , valid till Jun 2020. My GC application filed by my employer is in EB2 category I-140 approved stage with priority date of Sep, 2014. I-140 has been approved for more than a year. I have to move to Mexico City, México for about 15 months for a new assignment with the same employer, changing my base location for 15 months to Mexico City. Question: When I move back to USA after 15 months ( Around Dec 2018), since I would have worked for the same employer outside US for over a year in the last 3 years, can my GC category be moved to EB1-C as an International/Executive manager. I’ll be working in an executive manager position there In México and will be coming back to us in a similar position. Can it be done while I’m on H1B, or will I have to come back on L1A to do that? If this is possible, what is the process for the same? Thank you.
