Q.

How to convert Employment based I-485 to Family based I-485

Background
1. Currently on H1B visa for a consulting firm
2. I-140 approved – Jan 2009
3. I-485 filed-Sept 2007
4. Biometrics done- Jan 2008
5. EAD valid until Oct 2010
6. Married to a US citizen on 22nd May, 2009
7. Currently out of project (On Bench). My H1B Employer will run my payroll until May 30th, 2009 and cancel H1B sponsorship if I don’t find a job soon

Questions
1. What is the process of changing my employment based I-485 to family based I-485? Please provide the Form #s and documents that I will need to send to USCIS?
2. Do I need to file for a new EAD?
3. How long do you think it will take to get an interview and the Green Card?
4. Do I have to maintain my H1B visa status? Can I be without a job on EAD until my family based I-485 application is processed?
