Q.

Withholding of Removal

I am Nigerian, came into the country 2009, out of status on F1 VISA. I am married with two kids. My wife and the oldest son are in status; F1 and F2 respectively, and my youngest boy is a US citizen and will be 1 March 20th 2013.

I was arrested by ICE and was bonded out September 2011. I quickly applied for asylum(after 1 year) to withhold the removal by my lawyer. My individual hearing is scheduled for march 2013.

My question is this: Will I be favored by the new rule on this link:

Do you see light in this case? Please advice
