Q.

Was she out of status ?

My wife came to US first in Oct 2005 on H4 Visa with my 1st employer's stamping. Then we went back to India in April 2006 and I came back and Shifted to 2nd employer.The same Company (My 2nd employer) applied for her H1B in March 2007. My wife got her H1B approved and along with the approval she got new I-94 valid till Sep 2010. But she was not able to start working/ find a job due to family reasons and economy conditions. Now came a point where her H4 VISA Stamping got expired on Sep 2008 from my 1st employer on the passport.
1. Was she Out of status since she did not work on her H1? Her H4 valid till Sep ‘2008.
2. If she starts working now for the employer can she get back the status?3. What are the ways for her get back to H4 if she not going work? 4. How we can correct her status?
