Q.

Change of status from H4 to H1B if H4B dissicion is pending.

Hi Dimitar,
My spouse is loosing her H1B job on 31 Aug 2011 (she has an I-94 valid till 31 Aug 2011).I plan to apply for her H4 before that date (as i am on H1B too)
She might be hired by an University within a few weeks after 31 Aug 2011 and the University plans to file a H1B premier processing.
Under these circumstances kindly review my questions below
1) In case the University files a H1B premier processing and the H4 decision is pending does the USCIS approve the pending H4 too.( i will assume so)
2)Can she go back to her country while H4 decision is pending and apply an H1B from the country of origen and reenter US on new H1B.

3) can you suggest the best possiable options under these circumstances.
