Q.

First I-140 appeal withdrawn, second I-140 transfered to AAO

First I140 was denied on the grounds of education equivalency and then company filed Appeal to AAO.
In the mean time I joined another company and filed a new GC, got the Labor approved and filed for new I140/485 while the previous appeal was still pending.
I don't know why but both the new I-140 and I-485 were transferred to AAO by USCIS in December 2010.
My previous employer withdrew the appeal for the denied I140 in February 2011. Now the new I140/485 are pending with AAO for the last 6/7 months.

What is the best way to move forward with this case?
A Lawer is advising to pay $1000 now to USCIS to expedite the I140. Can I still pay $1000 to expedite the I140 process while the new I140 is with AAO?
