Q.

i-140

hello
I am currently on h1b visa that is expiring next year
my work tried to do PR through LC but advertisment failed
so an immigration attorney said she can apply for me for i-14o using eb2 Classification for NIW classification

my big question is as I am canadian citizen , i was thinkin when h1 ends to switch back to TN
so if i-140 denies for any reason ,this is on my history/record, will that lead to me not able to change back to TN when h1 ends because it showed immigration intent

second question , would it make a difference if she sends both 140 and 485 in showing immgation intent or is it safer to just send 140 or it does not amtter either one shows immiration intent
