H1B revoked,without releiving letter or return airfare
Hi Indu,
A friend of mine has been laid off second week of Jan 2011, and his employer just revoked his H1B petition. Apparently his employer has not given a formal relieving letter, has not paid the return airfare to India, and has not received his final paycheck
1) How long can he still stay in US?
2) He consulted another lawyer, and that lawyer says he has another 6 months to stay in this country, as his employer has not issued a formal relieving letter or paid the airfare. Is this true?
3) Even if there is a rule permitting my friend to stay in the country, is it advisable to do so?
