Q.

First I-140 on appeal, second I-140 transfered to AAO

In 2005, I filed for a traditional green card under EB2 (masters degree) at the NSC (Green Card 1 - GC1). The I-140 was denied on grounds of education equivalency in 2008 (5-years engineering diploma from Europe which was translated 2 times into masters by evaluators), after which I've been on appeal since.

In 2010, I filed for a PERM green card under EB2 (using experience + bachelors degree) at the TSC (Green Card 2 - GC2). The I-765/131 were accepted. But both the I-140 and I-485 were just transferred to the appeal's office (AAO).

What is the best way to move forward with this case? Company lawyer is advising to remove the first application (since it was based on a different role in the same company) so that I-140/485 can be processed back in the TSC.
