Q.

PW > Salary, Impact on EB2

I’ve 485 filed in EB3 with PD 5/2004 with Co. A (labor Substitution, not joined this sponsorer anytime), trying to file new case in EB2 with exiting employer B and port EB3 PD in EB2

PW application detail
Title: Functional Area Manager-Financial Systems
Req.: Bachelors + 5 yr
Level 4 SOC/O’Net Code 11-303102
OES $143,707

1. My salary-$128k is less than PW-$143k, which is forcing my employer to reduce the experien. req. from 5 to 3 yr to get lower PW-120k. Will it close the option of filing in EB2?
2. Pls advice the way to get the lower PW so that I still qualify for EB2? Actually I’ve Bach + 15 yr prior to current employer B with Manager IT position
3. Can we include bonus in my existing salary to justify that I am getting over PW?
4. Any flexibility by USCIS if salary < PW?
