I-140 Approved July 07 (NIW Self ) Unable to file I 485.
I-140 EB-2 Approved July 07 (NIW /Self ) country of chargability India Unable to file
I-485 as the priority dates are not current.I Have an Approved I-824 (May 2010)Recently laid off and planning to move back to India and join a job in India My field of NIW approval and work in India is different.
Few Questions
1) Can I obtain my green card in India once the dates are current.Do you foresee any complications.
2)Once the priority dates are current can I come back to USA and file I 485 at that time so as to obtain EAD and Advance Parole.
3) My spouse is exactly in similar situation (EB-2 NIW July 07/Self /India)will continue working on H1B in USA Once priority dates are current for her can we benefit from each other in terms of filing I-485.
