PERM Denied
My PERM application was denied since my qualifications listed on Form 9089, a Masters degree & 1 yr experience is not substantially equivalent to the employers primary requirements a Bachelor's and "none" experience."
My company has filed a motion to re-open the case claiming that the minimum primary requirements provided is Bachelors and 3 yrs of experience, and there has been an oversight by the officer reviewing the case. My company lawyers also noted that there were 4 other cases within the company denied for this exact reason.
My questions is -
1. What is the chances of this getting resolved and how long does it take to correct this issue?
2. My PERM was filed 2 days prior to 365 day before end of my H1-B limit, what are my options if PERM is denied for any other reason?
