Q.

i687 Denied and my cousin has since returned to Nigeria

Hello, My cousin's case was denied in 2007 b/c USCIS claimed that the evidence provided during his CSS & LULAC amnesty application did not substantiate that he lived here in the 80's. He returned 15 months later to Nigeria & has married his US citizen girlfriend in Nigeria when she visited him in Nigeria last year. What are the chances of him being able to legally return to the States and what is the process? If she files a petition (i130 I believe), will this get approved if they submit all the necessary documents or is he banned from returning to the US b/c his case was denied? If it is, what options are left? Can his wife prove hardship as a result of him not being around to support her or is there absolutely nothing legally available 2 them to bring him back to the states?
