EAD Vs H4
My friend is on H1 (need to get it stamped as the visa expired) and his spouse is working on EAD (her AP expired).
They have an emergency and need to leave the country immediately, so as per peoples suggestions.
Both can leave now without AP, my friend can get his H1 stamped and spouse's H4 stamped in India, and they can come back on it.
Though the spouse is on EAD now, this would still work, and once she comes back, she can move back to EAD from H4.
Will this work and still be valid?
