Q.

I539 filed under wrong name got approval

My wife's H1B and my H4 extension was filled on 7/23/09. We got our approved I-797A notice and I-94 on 9/16/09 respectively . However employer lawyer filled my H4 I539 with wrong name.
My name is
Aaa (first) Bbb(middle) Ccc(last).
Layetr has filled it as Aaa Bbb.
Instad of my Last name it is reflecting my middle name.
Please advice me on process to get my I-797 and I-94 rectified. I have plans to travel to India very soon.
Do I have to file I539 again? or current application can be rectified. Is my status legal? as I have stayed with expired I-94 for 53 days while this application was in process.
How long will it take to get this problem rectified?
Please advice me on whats the best way out of this problem.
