Q.

I-539 - COS

Dear Mr. Michailov
I had applied for my COS from H1B to H4 visa in June 2011 and the application is still under process. The dates I has requested were till Sep 30 2011 as per my Husbands previous H1B. Last week his company applied for his H1B extension and today he got his receipt notice. I want to file a 2nd I-539 application to request the same dates for my H4 as on his new H1B extension. My Questions are:
1. In the I-539 application that I will be filing now ( 2nd I-539 )
a) Should I request for COS from H1 to H4, since my 1st I-539 that I had applied in June is still under process?
b) Or should I request for Extension of H4 as I had already applied for COS from H1 to H4 in June?
2. My 1st I-539 applied in June is still under process. So what visa status am I on right now?
