Q.

H4 valid but I 94 expired !

I am on H1B visa and my 6 year term ends on Sep 2011 so its valid till Sep 2011.Also my I 94 is valid till Sep 2011. My PERM is approved and I 140 is currently pending .My wife is on H4 visa with me here and her visa is valid till Sep 2011. But saw today her I 94 got expired on Feb 27 2011.Havent yet started any extension work for her visa.(1)Heard about Nunc Pro Tunc . can this used in this scenario. If yes how long will this take to get approved ,before the 3 year ban for over 6 months overstay.(2)If planning to go back to India ,can she use her existing H4 visa (valid till Sep 2011) to travel back here to get I 94 restamped on poe(port of entry).
3) Or will she need a new H4 visa to fly back here from India. if yes ,why cant she use her existing valid visa(4)Any other ideas/options ?
