I am filling an I-130 for my parents, back in 1997 they had an over stay (visit visa B1/B2 expired). While on their overstay, they drove to Canada and on the way back they were stopped by INS. Later on they were giving a court date where they had requested for a volunteer departure. Judge had allowed volunteer departure and was giving a month or so to leave. They left and submit the documents (close envelope giving by the court) to local American embassy. Now on I-130 question 16 “(Has your relative ever been under immigration proceedings) which option should I chose….__Removal __ Exclusion/Deportation__ Rescission__ Judicial Proceedings?
