Q.

I539 Status change H4 to F1

Hi Friends,

I am converting from H4 to F1 for studies. I am in middle of filling I-539 and I am struck at 2 questions

3a) Are you or any other person included in the application an applicant for an immigrant Visa

3b) Has an immigrant petition ever been filed for you or for any other person included in this application?

My husband who is on H1 got his I-140 recently...so do we have to answer this as YES...? if it is YES, will there be any issues on status change. Please advise. Thank you..
