I am currently on H4 (also possess EAD, AP, EB-3, PD-October 2006),I will be joining my medical residency on June 2011 on H1B. My Husbands H1B & my H4 visa were renewed when our I-94 expired on 2009. I plan to go to India before my residency starts and come back to work on H1 to have visa status. Need to know few options-(1) Can I get my passport stamped without my husband’s passport stamped as he will not travel with me.(2)Can I come back on Advance Parole and then apply for H1B(3)If I apply H1B visa after I return back to US and if takes long time for H1B approval,can I work on EAD until that time?(4)is it advisable to obtain H1B visa and then travel to India so that I can return back on H1B(5)If my H1B visa does not get stamped, can I return back on Advance Parole and work back on H1B
