I-485 denial based on grandfathering (245i)
Hello, I'm from Dom. Rep. living in Florida.
The story:
On July 31, 1986 I married my wife. Her mother (LPR) filed an I-130, approved Feb 5 1987. We withdrew it because we were married at the time of filing.
She entered US on July 23 2001 on a B2 visa, I arrived in 2003. Her mother, now citizen, filed another I-130 in 2006 for married daughter, approved on April 2010.
The lawyer wrongly submitted our I-485 and I-485(a) for grandfathering with 245i. We got work permits, I-485 denied on the interview because we were married at time of filing.
29 days later we got decision: Your App. to register permanent Residence is denied. In accordance with 8 CFR 274a.14(a)(1)(ii), your employ. author. is terminated based on the institution of removal proceedings against you. What can we do now?
