I'm Canadian Citizen (Indian Born) working on H1-B & my wife is on H4 ,Our I-94 is valid till June 30, 2010,I'm on my 8 th year of H1
with I140 Approved PD June 2007, No 485 Applied.
I'm changing my employer for new Opportunities also my visa from H1-B to TN,Planning to get TN on Detroit Border, Where as My Wife who is Indian Citizen & she does NOT have Canadian Immigration either Is she Eligible for Dependent Visa TD If YES can she Apply for change of Status with in US by applying
form I-539 or does she need to leave country to change her visa status from H4 to TD? Assuming my Visa changed successfully on Border before June 30, 2010 ( within validity of my I-94), Can I come back & Apply for my wife change of status from h4 to TD while she is stays within USA .
