Q.

Brother is US citizen - getting green card while I am in the US.

My brother is an US citizen(naturalized) and intends to sponsor me/family for GC. I am in the US on H1 and employer GC process in progress (EB3-PD-11/07). I was reading uscis.gov/USCIS/New Structure/3rd Level Left Nav Children /Resources-3rd level/How Do I Guides/A1en.pdf
Under the secion "How do I file?": "If your relatives are already in the US and entered legally, ...lawful permanent resident at the same time as your file the I-130 relative petition...."

Given the above information, can we submit both I-130/I-485 sametime (since already in US and entered legally). Does this help me at all, or do I have wait in the line for over 10 years, since it would be family-based GC. Does the definition of "relative" in the above reference cover me?
