Q.

I-130 I-485 while in the US

Dear Sir,
I married an American Woman Dec. 23rd and now my company has laid me off since I wanted to stay with my wife rather than going back to Europe.
At this point my last day was Jan 3rd and I am about
to submit all visa info today, Jan 13th:
with said, am I already in the US illegally, since my e-2 visa expired Oct11th
still working with my co back than?
My I-94 grants a stay until Sept 16th 2011, but based on the E2 visa I entered
with.
Do I need to leave the US or can I negotiat a later termination date with my Co. Until all forms have Been approved?
Or do I only need one confirmation, let's say that my I-130 of my wife has been granted, not to have to leave and file in Germany?
What if the co does not change last day? Do I have to leave then? Thanks a lot J
