Q.

L1 to L2 Change of status

I am working in US on L1 visa with an approval notice and new I94 valid till Sep 2011. My spouse is also in US on L1 Visa valid till March 2010. She will be resigning her job by the end of sep 2009. We want to change her status from L1 to L2 based on my L1 Approval notice.

1. When should she be applying for COS?
a. While being employed on L1 ie from now to Sep 2009?
b. After her last work date (25/Sep/2009)? if yes, how long do we have to apply for Change of Status?

2. Does her L1 status gets void immediately after her last working date?

3. Will she be acquiring illegal -stay or status, if there is a delay in applying for COS and Last working date?

4. Can she process this Change of Status through our own attorney instead of my organization's attorney?
