Q.

L1 , L2 visa

I am on L1. My wife is working on L2.
She got her H1 approved. My company has asked me to go back to india,
can my wife stay in US on pending status until she joins the job in october 2009?
Can I resign from my company and be in US on pending status.

Second question: I had H1 visa from 2000 to 2004 janurary and had to go back to india. My H1B Visa stamping was rejected on conditional basis in 2004. I then came to US in October 2005 on L1 visa through another company.
Is it possible to transfer my l1 visa to h1b visa? Is Change of status possible?
