Q.

L1A extension denied. I94 expired.

Current status: L1A extension denied, I-94 expired, H1 with different employer (however cannot be used without getting it stamped in India). My husband is on H1B.
1. My company is ready to apply for a H1 for me under the current quota, will that be a problem when I have a H1 with another employer.
2. If I change my status to H4 and stay in US, can I still apply for H1 and work from Oct 09 without going to India at all.
3. Can my company (that sponsored L1A) do a cap-exempt processing on the H1B (which I already hold) to allow me to work in USA (without changing companies) before Oct 09.
