Q.

L2 or H1B

I am on BL1 and my spouse on L2.Our visas expires on Aug18'11 and so does her L2 EAD because of which she can’t continue working after that date.My employer has initiated the visa extnsn for both of us.FYI,my employer will not do L1 in premium and her employer may do H1B in premium for her.
How and what should we do to have her continue her stay and work?
1)If I stop L2 processing for her and her employer processes H1B premium for her,can she continue her stay and work in the US after Aug18th with the receipt received from USCIS?
2)Should I continue L2 processing for her in which case she cannot work after Aug 18th 2011 until the extension happens which would be around December?.I then may not want her H1B also started during this time(dual status application).
What is the best option?
