Q.

L1A-H1B COS in the 7th year based on pending GC PERM filing?

Hi I entered the US on Sep24,2004 on L1B and am currently in my 7th year of L1A (L1B-L1A changed in 2008) with my PERM filed in dec 2008 pending decision. My 7 years are ending sep 2011. Since my GC is unlikely to come before Sep2011 can I file for a L1-H1B now out of the 2011 quota(in my 7th year) and file for an extension based on the pending GC ?

Is so what date would the h1B be valid for since I am beyond the 6 year H1B limit ? Does the 6 year H1 limit apply for L1A to H1B cos ? By when do I have to make this switch ?

If not, would it have made a difference if I had a H1B approved without COS from 2010 quota but got it stamped now and filed for an extension ?
