Filing AoS but never got a visa in passport
My husband is Canadian and in the U.S. on an L1-B. We want to file an AoS for his green card. There is no actual visa in his passport--only his I-94 card that states he has L1 status and we have an approved I-797 for the L1 as well. The company attorney said a long time ago that since he is Canadian, no hard copy of his L1 visa exists. According to him, Canadians fall under the "blanket visitor visa" even when they have a different status. Is this correct?
How is this going to affect his application for AoS since we have no copy of the L1-B visa and no visa number since supposedly there isn't one? Should I submit additional documentation letting USCIS know the situation? He has a valid U.S. SSN but no EAD. His L-1 expires in September 2010.
