Q.

How to COS to F-1 from L-2 COS I-539 Pending

Hello Dimitar,

This is the case in short:

0) F-1 OPT status right now till Dec 23 2008, H-1 not selected.
1) I-539 filed - August 5 - Vermont Center - still pending
2) I-765 filed - August 25 - California Center - EAD in hand and used for employment.
3) Taken admission in an univ - new I-20 in hand.

Right now because I am using the L-2 EAD I am on the L-2 status. How do I transfer to F-1 CPT status while the L-2 COS I-539 is pending? I want to transfer because my spouse may loose her job and then we both will be out of status.
