My son, a US citizen, is in Australia with his wife, who is 4 months pregnant, whom he married there in Jan 2010. His visa ends on August 25, so his wife applied for a 1 year nonimmigrant visa to come to the US with him. They have round trip plane tickets. She was denied the visa. What should she do? Can she come here using the visa waiver program while they start the permanent I130 procedure right away? They want to know if her denial of the temp visa will now invalidate using a visa waiver to come here. And should she start the process to get a permanent green card while still in Australia or in the US if she can come here using the visa waiver.
