I am a physician doing a fellowship program on a J1. My status will expire august 24, plus 1 month grace period. I now have a J1 waiver application pending which is at the DOS level for a J1 waiver job.
If I file for my H1b between august 24 and sept 24, right after the DOS makes the recommendation for the waiver to USCIS, will I be considered out of status for the time I have to wait for my H1 to process? could any waiting time after sept 24 put me at risk for being denied an H1 visa stamp if I visit my country in the future?
