J1 to H1 B
I was on a J-1 and got a waiver based on No objection from home country. The Department of State forwarded favorable recommendation to USCIS vermont center. I also received a copy from Department of State. Almost after 6 weeks and after contacting repeatedly, I got the receipt or case number from USCIS. I need to apply to H1-B (from NPO- uncapped).
-Can I apply to my H-1 B with the copy of Department of State Favorable recommendation and USCIS receipt number and request them to adjudicate my case?
- Is there any chance that USCIS will deny my H-1 B petition despite providing the receipt number for my waiver or the worst that could happen is RFE rather than denial?
- Is USCIS final approval I-612 mandatory to apply for H-1 B from J1 waivers based on No objection?
