Q.

H1B to J1

I entered US in 2005 on J1 and changed to H1b in June 2008. Now I got selected for Neurology residency which is on J1. The current internship is on H1B and ends 15th June and new program begins 1st of July. Should I leave for India on 15th June for a visa stamping or apply for J1 from here. I will receive my DS2019 by next week. I am not sure if I will be able to get my J1 approved till 1st of July if I apply from within US but people have told me that it will be very challenging for me to get the visa stamp while in India as my case is complicated with J1 to H1 to J1. Am I eligible to stay in US between 15th June when my H1b ends and until the approval of J1 visa.What happens if I am denied J1 visa approval while I apply from within US. Should I hire a lawyer for my case?
