Urgent : Regarding B2 / H4 status
I am on H1B status. My spouse is on B2 status now and it expires on 20-Oct-2008. I have filled her H4 petion with USCIS and it is still in pending status.
Will she be able to stay in USA after 20-Oct-08 with H4(which is in pending status)?.

Thanks for your question. Yes, your spouse would be able to stay in the U.S. past the B-2 expiration date of October 20. However, such stay would be authorized until the H-4 application is pending. Once it is approved, your spouse would be on H-4 status. However, if it is denied, your spouse will have to either appeal or exit the U.S. immediately to avoid accruing illegal presence.
