F2 to F1 - H1 query
I came to US on F-2 visa. I got admission for MS at ULM.
On 12/20/2007 - I sent Form I-539 to the USCIS seeking Change of Status – F2 to F1. The spring semester started on Jan 14th and I got my F1 approval on Feb 20th. I couldn’t register and enroll in the absence of my F1 approval notice.
I called the ISO of ULM and they told me that they cannot defer my admission, nor they can transfer me to a different school. I opted for filing H1B through a consultancy company and I got RFE asking to show proof that I am maintaining F1 status.

Sending the change of status approval may work, that is all you have at this point right? If you have a letter saying they will transfer you to another school, you should send that as well and see what happens. The worst thing that can happen (assuming they will approve your H-1b) is that you will go home to get the visa. |
