Laid-off. I-485 pending with EAD & AP. Can I travel outside US?
Dear Sir,
I was laid off last week. My i-140 NIW has long been approved (PD June 03) and my I-485 has been pending for 3 years. I have valid EAD & AP. (Used EAD to work)
I have bought flight ticket and planned to travel back to China for 3 weeks and use AP to re-enter US. Now, is it too risky to leave US because I am unemployed? What would be your suggestion? Thanks!

Yes. It is too risky to travel in your situation, unless and until you have a new offer of employment in the same or similar job occupation. The new employer/sponsor should notify the appropriate USCIS service center by letter that you are "porting" under AC21 Section 106(c). Then, you should be fine to travel on your existing advance parole travel document. |
